INVITATION FOR NEGOTIATED PROCUREMENT - PROCUREMENT OF SHUTTLE SERVICES FOR THE NCCA FOR MAY- JUNE 2021

1. In view of the two (2) failed public biddings conducted for the project “Procurement of Shuttle Services for the NCCA for the months of May to June”, the National Commission for Culture and the Arts Bids and Awards Committee (NCCA-BAC), intends to negotiate, as authorized by the NCCA Executive Director, per BAC Resolution No.2021-12 dated April 27, 2021, in accordance with Section 53.1 of the 2016 Revised Implementing Rules and Regulations (IRR) of Republic Act (R.A.) No. 9184, otherwise known as the “Government Procurement Reform Act.” The NCCA, through the CY 2021 National Endowment Fund for the Culture and the Arts (NEFCA) intends to apply the sum of One Million Eight Hundred Thirty Seven Thousand Five Hundred Pesos and Zero Centavos (Php 1,837,500.00) being the ABC to payments under the contract for PB 2021-09 Procurement for Shuttle Services for the NCCA for May-June 2021. Bids received in excess of the ABC shall be automatically rejected at bid opening.

2. The NCCA-BAC now invites Offers/Proposals for the said project. The delivery of the Goods/Services is required from May to June 2021, or until the proposed budget for two (2) months has been fully consumed. Bidders should have completed, within Three (3) Years from the date of submission and receipt of bids, a contract similar to the Project. The deion of an eligible bidder is contained in the Bidding Documents, particularly, in Section II (Instructions to Bidders).

3. Interested bidders may inspect the Bidding Documents from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the website of the NCCA.

4. The NCCA-BAC will hold a meeting with all interested bidders on May 7, 2021, 10:00 a.m. To reduce the risks and hazards of community transmission of COVID-19, the BAC shall conduct meetings and conferences via Zoom until further notice, or until such time that the state of calamity, or implementation of community quarantine or similar government restrictions shall have been lifted by the proper government authorities.

5. The Eligibility Documents, Technical Proposal, and Best and Final Offer stated in the checklist shall be submitted (manual submission) in one (1) original and two (2) duplicate copies on or before May 11, 9:00 a.m., NCCA Bldg., 633 General Luna St., Intramuros, Manila. Late bids shall not be accepted.

6. The NCCA-BAC shall conduct the meeting for the opening of the Eligibility Documents, Technical Proposal, and Best and Final Offer on May 11, 10:00 a.m., via Zoom. Authorized attendees, including representatives of bidders, who are physically present at the NCCA Board Room, Intramuros, Manila, shall likewise join the meeting via videoconferencing.

7. Only interested bidders who paid the fee in the amount of Five Thousand Pesos (P5,000.00) shall have their best and final offers opened. Best and final offers received in excess of the ABC shall be automatically rejected.

8. Bidding is restricted to Filipino citizens/sole proprietorships, cooperatives, partnerships, or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines.

9. The NATIONAL COMMISSION FOR CULTURE AND THE ARTS (NCCA) reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with sections 35.6 and 41 of the 2016 Revised IRR of R.A. No. 9184, without thereby incurring any liability to affected bidder or bidders;
