REQUEST FOR OF INTEREST FOR PROCUREMENT FOR CONSULTING SERVICES FOR THE VALIDATION OF THE FORECASTS EXPENDITURE FOR THE FIFTH REGULATORY PERIOD (5TH RP) OF

THE FIRST ENTRY GROUP OF PRIVATELY OWNED ELECTRICITY DISTRIBUTION UTILITIES (DUS) IN

SETTING THE DISTRIBUTION WHEELING RATES (2ND BIDDING)

1. The Energy Regulatory Commission (ERC), through The Government of the Philippines (GoP) ) General Appropriations Act for Fiscal Year 2021, intends to apply the sum of Twenty-five Million Pesos (PhP25,000,000.00), inclusive of all government taxes and other charges and fees, being the Approved Budget for the Contract (ABC) to payments under the contract for Consulting Services for the

Validation of the Forecasts Expenditure for the Fifth Regulatory Period (5th RP) of the First entry group of Privately Owned Electricity Distribution Utilities (DUs) in setting the Distribution Wheeling Rates (2nd Bidding), (Lot No. 2021-27). Bids received in excess of the ABC shall be automatically rejected at the

opening of the financial proposals.

2. The ERC now calls for the submission of eligibility documents for Consulting Services for the Validation of the Forecasts Expenditure for the Fifth Regulatory Period (5th RP) of the First entry group of Privately Owned Electricity Distribution Utilities (DUs) in setting the Distribution Wheeling Rates (2nd Bidding). Eligibility documents of interested consultants must be duly received by the BAC Secretariat on or before 14 May 2021 at 12:00 P.M. at 8th Floor, Pacific Center Building, 33 San Miguel Avenue, Pasig City. Applications for eligibility will be evaluated d on a non-discretionary “pass/fail” criterion. Prospective bidders are requested to bring the originals of the documents submitted and present the same for comparison during the opening of eligibility documents.

3. Interested bidders may obtain further information from BAC Secretariat and inspect the Bidding Documents at the address given below during Monday to Friday, 9:00 A.M. to 4:00 P.M.

4. A complete set of Bidding Documents may be acquired by interested Bidders on 6 May 2021 from the address below and upon payment of a non-refundable fee of Twenty-Five Thousand Pesos (PhP25,000.00).

It may also be downloaded free of charge from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the website of the Procuring Entity, provided that Bidders shall pay the applicable fee for the Bidding Documents not later than the submission of their bids.

5. The BAC shall draw up the short list of consultants from those who have submitted of Interest, including the eligibility documents, and have been determined as eligible in accordance with the provisions of

Republic Act 9184 (RA 9184), otherwise known as the “Government Procurement Reform Act”, and its Implementing Rules and Regulations (IRR). The short list shall consist of Five (5) prospective bidders who will

be end to submit bids. The criteria and rating system for short listing are:

(Note: Only the top 5 ranked Firms with at least 70% points d on

the short listing criteria will be invited to submit the Technical and Financial

Proposals. Should less than the required number apply for eligibility and

short listings pass the eligibility check, and/or pass the minimum score

required in the short listing, the BAC shall consider the same.)

6. Bidding will be conducted through open competitive bidding procedures using non-discretionary “pass/fail” criterion as specified in the IRR of RA 9184.

Bidding is open to all interested bidders, whether local or foreign, subject to the conditions for eligibility provided in the IRR of RA 9184

7. The Procuring Entity shall evaluate bids using the Quality d Evaluation (QBE). The criteria and rating system for the evaluation of bids shall be provided in the Instructions to Bidders.

8. The contract shall be completed within a total period of one hundred eighty (180) days, commencing from the date of the Notice to Proceed (NTP) to the winning bidder.

9. The ERC reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with Section 41 of RA 9184 and its IRR, without thereby incurring any liability to the affected bidder or bidders.
