DESIGN AND BUILD
CONTRACT FOR THE PROVISION OF BULK WATER SUPPLY
FOR THE
MOST AFFECTED AREA (MAA) IN MARAWI CITY
1. The Local Water Utilities Administration (LWUA) Bids and Awards Committee (BAC) 1 intends to apply the sum of One Hundred Seventy Three Million Five Hundred Forty Four Thousand Two Hundred Thirty One Pesos and 1/100 (Php 173,544,231.01) being the Approved Budget for the Contract (ABC) to payments under the contract for Design and Build Contract for the Provision of Bulk Water Supply For the Most Affected Area (MAA) in Marawi City. Bids received in excess of the ABC shall be automatically rejected at bid opening.
2. The LWUA BAC 1 now invites bids for the above Procurement Project. Completion of the Works is required in Three Hundred Calendar Days (300 CD). Bidders should have completed a contract similar to the Project. The deion of an eligible bidder is contained in the Bidding Documents, particularly, in Section II (Instructions to Bidders).
3. Bidding will be conducted through open competitive bidding procedures using non-discretionary “pass/fail” criterion as specified in the 2016 revised Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 9184.
4. Interested bidders may obtain further information from the LWUA BAC Secretariat and inspect the Bidding Documents at the address given below during office hours (8:00 A.M. to 2:00 P.M).
5. A complete set of Bidding Documents may be acquired by interested bidders on April 29, 2021 from given address and website/s below and upon payment of the applicable fee for the Bidding Documents, pursuant to the latest Guidelines issued by the GPPB, in the amount of Fifty Thousand Pesos (P50,000.00) per set. The Procuring Entity shall allow the bidder to present its proof of payment for the fees in person, by facsimile or through electronic means.
While under Community Quarantine, payment for the bidding documents can be deposited by interested bidders to LWUA’s bank account below.

Bidders shall transmit the proof of payment (e.g., deposit slip) to the LWUA’s designated email account, i.e., bac.oad@lwua.gov.ph.
6. The LWUA BAC1 will hold a Pre-Bid Conference on May 7, 2021, 10:00AM at G/F LWUA Bldg., LWUA-MWSS Compound, BAC Bidding Room at Katipunan Ave., Balara, Quezon City and/or through video conferencing
/webcasting via zoom, which shall be open to prospective bidders.
Should the Community Quarantine, in view of the COVID 19 pandemic continue in Quezon City, the conduct of the Pre-Bid Conference shall be through video conferencing using IT platform (zoom). Interested bidders may join on line through to be provided.
Interested bidders may join the online conference by following the steps below:
1. Send an email to LWUA BAC 1 signifying to join via online platform;
2. Wait for the invitation from LWUA BAC 1 to join the meeting through email;
3. Click meeting button;
4. Wait for the host (LWUA BAC 1) to accept/admit the request;
Interested bidders who will attend the Pre-Bid Conference in LWUA will be directed to a meeting lobby where the conference organizer will admit their representative’s attendance.
To facilitate monitoring of participants to the video conferencing facility, only one (1) authorized representative from the participating bidder shall be allowed access to the video conference proceedings.
7. Bids must be duly received by the BAC Secretariat through manual submission at the office address as indicated below, on or before May 19, 2021, 10:00 AM.. Late bids shall not be accepted.
Should the bid opening fall within the Community Quarantine period in Quezon City, the BAC reserves the right to suspend the procurement proceedings until further notice pursuant to GPPB Resolution No. 09-2020 dated May 7, 2020.
8. All bids must be accompanied by a bid security in any of the acceptable forms and in the amount stated in ITB Clause 15.
9. Bid opening shall be on May 19, 2021, 10:00 AM. at G/F LWUA Bldg., LWUA-MWSS Compound, BAC Bidding Room at Katipunan Ave., Balara, Quezon City. Bids will be opened in the presence of the bidders’ representatives who choose to attend the activity.
10. The LWUA BAC1 reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with Sections 23.6 and 41 of the 2016 Revised Implementing Rules and Regulations (RIRR) of RA No. 9184, without thereby incurring any liability to the affected bidder or bidders.
11. The bidders are requested to submit one (1) original and three (3) copies of the 1st and 2nd components of its bid proposal. All pages of the proposals (technical and financial) must be duly signed by the Authorized Representative of the Bidder.
12. For the detailed evaluation of the design and build proposals, a two-step procedure shall be adopted by the LWUA BAC 1 as specified in “Annex G” of the 2016 Revised IRR of RA 9184 as follows:
First Step Procedure:
1. Review of the preliminary conceptual designs and track record submitted by the contractor as indicated in the Bidding Documents using a non-discretionary “pass/fail” criteria that involve compliance with the following requirements:
1. Adherence of the preliminary design plans to the required specifications and parameters and degree of details;
2. Concept of approach and methodology for detailed engineering design and construction with emphasis on the clarity, feasibility, innovativeness and comprehensiveness of the plan approach, and the quality of interpretation of project problems, risks, and suggested solutions; and
3. Quality of personnel to be assigned to the project which covers suitability of key staff to perform the duties of the particular assignments and general qualifications and competence including education and training of the key staff.
2. For complex or unique undertakings, such as those involving highly specialized or advanced engineering technology, eligible bidders may be required, at the option of the agency concerned, to make an oral presentation within fifteen (15) calendar days after the deadline for submission of technical proposals.
Second-Step Procedure:
Only those bids that passed the above criteria shall be subjected to the second step of evaluation.
The LWUA BAC 1 shall open the financial proposal of each “passed” bidder and shall evaluate it using non-discretionary criteria – including arithmetical corrections for computational errors – as stated in the Bidding Documents, and thus determine the correct total calculated bid prices. The LWUA BAC 1 shall automatically disqualify any total calculated bid price which exceeds the ABC. The total calculated bid prices (not exceeding the ABC) shall be ranked, in ascending order, from lowest to highest. The bid with the lowest total calculated bid price shall be identified as the Lowest Calculated Bid (LCB).
