1. The Provincial Government of Davao Occidental, through its Bids and Awards Committee (BAC), invites all potential contractors to apply to bid for the following infrastructure projects:

2. Bids received in excess of the ABC shall be automatically rejected at bid opening.

3. The Provincial Government of Davao Occidental now call for the submission of Letters of Intent (LOIs) from the potential bidders to apply for eligibility for the above stated project. Bidders should posses a valid PCAB License applicable to the above-type and cost of the contract, have completed similar contract with a value of at least fifty (50%) percent of the ABC, and meet the other minimum eligibility requirements stated in the eligibility documents.

4. Bidding will be conducted through open competitive bidding procedures using a non-discretionary “pass/fail” criterion as specified in the Implementing Rules and Regulations (IRR) of Republic Act (RA) 9184, otherwise known as the “Government Procurement Reform Act”.

5. Bidding is restricted to Filipino citizens/sole proprietorships, partnerships, or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws or regulations of which grant similar rights or privileges to Filipino citizens, pursuant to RA 5183 and subject to Commonwealth Act 138.

6. The documents required in the eligibility documents shall be submitted as part of the technical documents of the bidders as provided in the Instructions to Bidders. Eligibility/Technical

and Financial documents must be book bound respectively. Any document submitted, not book bound shall be rejected outright.

7. Interested bidders may obtain further information from the Provincial Government of Davao Occidental and inspect the Bidding Documents at the address given below during from 8:00 a.m., 12:00 noon, 1:00 p.m. 5:00 p.m. Mondays to Fridays.

8. The Provincial Government of Davao Occidental, reserves the right to accept or reject any bid, to annul the bidding process, and to reject all bids at any time prior to contract award, without thereby incurring any liability to the affected bidder or bidders.
